I'm not sure how small town judges are, but in big cities, the docket is so crowded, the judges don't give a crap and always favor prosecutors and police.
Obvious reasons. The prosecutors and judges share the same floor of the building. They eat breakfast and go to lunch together. The favoritism is ridiculous.
The only way to beat a traffic ticket in big cities via trial is by political donation to the judge or having a relationship with the judge. Judge's should leave tip jars on their desks.
We got everything thrown out. Pictures, cameras and we impeached the police officer to the point where his entire testimony was thrown out. There was absolutely no evidence left.
The state has the burden of proof, and they have to prove their case using the available evidence - not the defendant! How do you prove a case without evidence? Well, judges don't care. You get *guilty* every time.
Bullshit traffic tickets are a minor nuisance for most people, but for others, it's critical to their careers to keep their records clean, such as truck drivers who are in danger of losing their trucking license. They're losing their whole livelihood over a lie.
I haven't done a traffic case in years, but we learned that the best way to beat tickets is by gaming the system, causing delays & basically letting the ticket expire. Shameful, tricky, slimy but in the face of such corruption, it's the only way.
